Hypefest Hong Kong 2024 – EVENT TERMS AND CONDITIONS
These terms and conditions (the “Terms”), apply to all participants of the Event. Your attendance at the Event indicates your agreement to these Terms.
1. Definition
- "Company/we/us/our" means Hypebeast Hong Kong Limited
- “Event” means Hypefest Hong Kong 2024 to be held on 9 -10 November 2024
- “Ticket Agent” means KLOOK Travel Technology Limited
- “Unauthorized Items” means items as set out in clause 2.10
- “Venue” means Central Harbourfront Event Space, Central, Hong Kong
2. Entry of Event
- 2.1 You must hold a valid ticket to enter the Venue and attend the Event. Each ticket entitles admission for one person. A maximum of 8 tickets may be purchased per transaction.
- 2.2 There will be designated entry points for participants aged 18 and over, and a separate entry point for participants under the age 18. Upon entry, you will be issued a wristband designating your age eligibility. Participants aged 18 and over will receive a wristband granting them access to purchase alcohol at the Event. Participants under the age 18 will receive a different wristband that does not permit alcohol purchase and consumption within the Venue.
- 2.3 We will require participants to provide a valid HKID or passport to verify their age. If security or our personnel discovers an underage participant has obtained the over-18 wristband through deception, they will be required to return to the designated under-18 entry point to receive the proper wristband. Providing false information to obtain the wrong wristband is strictly prohibited.
- 2.4 You can re-enter the Venue on the date(s) specified on your ticket by presenting your wristband, subject to capacity limitations of the Venue. You must not transfer the wristband to or exchange the wristband with other individuals.
- 2.5 The Company will not replace any entry wristband that are lost, stolen, damaged or used after they have been redeemed.
- 2.6 The entry wristband is only used for the entry on the day of the Event, and anyone who purchases a two day pass must redeem a new wristband at the venue entrance every day for admission. 2.7 Each ticket can only be used once to redeem an entry wristband and the QR code will expire and cannot be reused once used.
- 2.8 Any ticket holders must enter the venue at or before the latest opening time of the event, i.e. 10:00 p.m. This also applies to re-entry of all ticket holders.
- 2.9 Security check is a condition of entry to the Venue. You hereby consent to having your bags and personal belongings searched to enter the Venue. . You are not allowed to bring bags exceeding the dimensions of 38 cm X 30 cm X 20 cm (i.e. 15 inches X 12 inches X 8 inches) into the Venue.
- 2.10 You are not allowed to bring the following into the Venue:
- (a) food, drinks (including alcohol) and liquids;
- (b) professional photography or video equipment;
- (c) cigarettes (including e-cigarettes), matches and lighters;
- (d) pets or animals, except approved service animals (e.g. guide dogs);
- (e) glass vessels, illegal drugs or substances, knives or similar weapons including chains/chain wallets, fireworks, explosives, gas canisters (including aerosols), items that are sharp or have pointed edge(s), and any items that may endanger public safety;
- (f) long umbrellas, selfie sticks, camera tripods, musical instruments, megaphones, air-horns, independent sound systems and generators, laser pointers, drones, chairs and any items that exceed foot long or may interfere other participants’ enjoyment at the Event;
- (g) any unlicensed flag, banner, emblem or wording; and
- (h) any items that contain unauthorized logos of the Company and the Event.
- 2.11 No ticket scalping is allowed. The Company reserves the right to void any ticket sold if it has been used, resold, shared or used for any unauthorized commercial purposes.
- 2.12 We reserve the right to refuse to accept any tickets that are not purchased from our official Ticket Agent. Tickets purchased from unofficial platform(s) or any unofficial third party may be canceled without any refund or compensation.
- 2.13 A confirmation email and e-ticket will be sent to the ticket holder’s designated email address that is provided during the ticket purchase. Please ensure that the email address is correct. No change of email address is allowed after the ticket is purchased.
- 2.14 We reserve the right to refuse admittance to or expel from the Venue anyone that brings Unauthorized Items, engages in illegal or violent activities and does not comply with these Terms. We will report to the police for any suspected illegal acts. You consent and agree that in such events, you will not be entitled to a refund of any portion of amounts paid. Breach of any of the Terms shall entitle the Company to all available legal remedies.
3. Attendance Rules
- 3.1 You must comply with all laws and regulations, observe rules of the Venue and follow instructions provided by the staff of the Event. You must not engage in any illegal, violent or anti-social activity or behave in any disorderly, disruptive or aggressive manner that negatively affects the Event or safety of the performers, any other participants and persons at the Venue.
- 3.2 The following activities are strictly prohibited:
- (a) stage diving, moshing, climbing, crowd surfing;
- (b) use of drugs, including legal highs;
- (c) urinating in public places;
- (d) underage drinking;
- (e) sale, distribution, or display of any unauthorized merchandise, goods, or promotional materials within the Venue
- (f) entering restricted or staff-only areas without authorization;
- (g) damaging or defacing Event and Venue property or facilities; and
- (h) engaging in any speech or conduct that fails to comply with relevant laws, regulations, and policies, including those pertaining to national security matters
- 3.3 Smoking and vaping are not allowed.
- 3.4 Please consume alcohol responsibly.
- 3.5 Personal photography and video recording using smartphones or basic compact cameras is permitted for non-commercial use. However, the use of professional photography/video equipment and audio recording devices is strictly prohibited without prior written authorization from the Company. 3.6 Parking is not allowed on the Venue.
- 3.7 You may use the storage service provided at the Venue subject to the storage service provider’s terms and conditions on a first-come-first-serve basis. However, we shall not be responsible, financially or otherwise, for any personal property that is left, lost, stolen, destroyed, confiscated, damaged or misplaced anywhere on site or during the Event. You should always keep your valuable belongings with you .
- 3.8 Breach of any of the Attendance Rules set out in this Section 3 shall entitle the Company to exercise its right to refuse admittance to or expel from the Venue anyone in accordance with Section 2.7. 3.9 You shall indemnify and hold harmless Company, and any representatives, shareholders or officers thereof, against any and all liabilities, damages, costs, penalties, claims and expenses (including without limitation reasonable legal fees and expenses) incurred by any of them by reason of (a) breach of any Attendance Rules in this Section 3 and these Terms by you; and (b) your gross negligence or willful misconduct at the Event.
4. Limitation of Liability
- 4.1 To the extent permitted by applicable law, and save in relation to instances of gross negligence, reckless conduct, willful/wanton conduct, or intentional acts by the Company, you, in the capacity of yourself and your related persons, hereby fully understand and knowingly, voluntarily, and irrevocably assume all risks, hazards, and dangers related to entry into, and presence in, at and around the Venue and Event. These risks may include, but are not limited to, an increased risk of exposure to communicable diseases (including, without limitation, COVID-19), viruses, bacteria or illnesses or the cause thereof, as well as the potential for sickness, personal injury, disability, other short-term or long-term health effects, and/or death. You hereby waive and release any and all claims, causes of action, or other rights you may have against the Company related to such assumed risks.
- 4.2 We shall bear no responsibility for the messages displayed or communicated by any third party during the Event.
5. Publicity Rights
- You hereby authorize the Company, its affiliates (if any), the Hong Kong Government and their authorized agents to: (i) tape and photograph you; and (ii) record your voice, conversation and sounds in connection with your appearance at the Event (collectively “Materials”). You agree that the Company shall be the exclusive owner of the results and proceeds of the Materials with worldwide, irrevocable, perpetual right to copyright, to use, license others to use, display, publish, distribute, modify, add, delete, dissimilate, create derivative works, in any manner, all or any portion thereof or a reproduction thereof in connection with the Event or otherwise. You expressly waive any and all so-called moral rights you may have in connection with your appearance.
6. Changes to Event
- Although the Event programme is correct at the time of publication, we reserve the sole right and discretion to alter or change the programme and line up without prior notification. We shall use our reasonable endeavors to announce such changes prior to the Event.
7. Force Majeure and Cancellation
- 7.1 A Force Majeure event shall mean event or events including, without limitation, any act of God, natural or manmade disaster, typhoon, heavy rain, pandemic or epidemic, war, strike, governmental action, terrorist activity or any other circumstances beyond our reasonable control and which are reasonably likely to affect the successful delivery of the Event or would make it inadvisable, impracticable, illegal, or impossible for us to host the Event or perform our obligations under these Terms.
- 7.2 If, as a result of Force Majeure, the Company cancels the Event, the Company shall in its reasonable endeavors to reschedule the Event within two months of the original Event dates but is under no obligation to do so, particularly if doing so is beyond the Company’s practicality or commercial feasibility.
- 7.3 If the Company is unable to reschedule the Event in accordance with clause 7.2, it shall refund the ticket fees as soon as reasonably practicable and in any event within 60 days from the date of notice of cancellation. Refunds shall be made by the Ticket Agent.
- 7.4 Without prejudice to the Company’s obligation to refund ticket Fees, the Company accepts no liability and shall pay no compensation where the performance of its obligations is made impracticable, illegal or impossible by or as a result of Force Majeure.
- 7.5 The tickets are not cancellable, non-transferrable, non-exchangeable by you.
8. Assignment
- 8.1 We may, without your consent, assign, sub-contract or transfer any and all of our rights and obligations under these Terms.
- 8.2 You may not assign, sub-license or otherwise transfer any of your rights under these Terms without our prior written consent.
9. Amendment
- These Terms may be amended by the Company at its sole discretion from time to time without notice. Your attendance of the Event after such amendments constitutes your acceptance of them.
10. Severability
- If any provision of these Terms is held to be invalid, illegal or unenforceable, such invalidity, illegality or unenforceability will not affect any other provision of these Terms, and the rest of these Terms will remain in full force and effect.
11. No Waiver
- Any failure or delay on the part of the Company to enforce any of these Terms shall not constitute a waiver of any of its rights hereunder.
12. Governing Law
- The Terms set out herein shall be construed and governed in accordance with the laws of Hong Kong SAR and the Hong Kong SAR courts shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms.
13. Language
- If there is any inconsistency or ambiguity between the English version and the Chinese version of these Terms, the English version shall prevail.
